A RESOLUTION

No. 2018 – 33

SUPPORTING THE ADOPTION OF THE MOLOKA‘I ISLAND COMMUNITY PLAN UPDATE TO INCLUDE THE FULL EAST END POLICY STATEMENT AND FULL WEST END POLICY STATEMENT AS FULL CHAPTERS IN THE PLAN, THE RECOGNITION OF COMMUNITY-BASED FISHERIES MANAGEMENT AS A DESIRED CONCEPTUAL FRAMEWORK FOR PERPETUATING THE NEARSHORE RESOURCES AND SUBSISTENCE TRADITIONS OF MOLOKA‘I RESIDENTS FOR PRESENT AND FUTURE GENERATIONS, AND THE ADOPTION OF LAND USE DESIGNATIONS THAT HAVE THE FORCE AND EFFECT OF LAW INCLUDING THE TRADITIONAL LAND USE OVERLAY DESIGNATION FOR CULTURAL AND HISTORICAL SITES, SITE COMPLEXES, AND LANDSCAPES

WHEREAS, Maui County’s regional community plans are intended to serve as living documents describing the specific needs, development objectives, and overall vision for Maui’s diverse and unique communities, to be developed and updated through an extensive community outreach and input process; and

WHEREAS, an update to the 2001 Moloka‘i Island Community Plan has been discussed, developed, and revised over the last eight years, through substantial public engagement at numerous meetings by the Moloka‘i Island Community Plan Advisory Committee, the Moloka‘i Planning Commission, and the Planning Committee of the Maui County Council, as well as extensive community-driven deliberations and consensus-building by the residents of Moloka‘i; and

WHEREAS, it is critical that the Moloka‘i Island Community Plan Update truly reflect the unique values, needs, and vision of Moloka‘i residents for the future of their island, as evidenced throughout the years-long community plan update process; and

WHEREAS, Native Hawaiian and other residents from Mana‘e and East Moloka‘i have strongly and consistently voiced their desire for the Moloka‘i Island Community Plan Update to include an updated East End Policy Statement as a formal Chapter of the Plan, with all appendices and provisions as submitted by the East Moloka‘i community; and

WHEREAS, Native Hawaiian and other residents from Maunaloa and West Moloka‘i have likewise voiced their desire for the Moloka‘i Island Community Plan Update to include a West End Policy Statement as a formal Chapter of the Plan, as developed through an extensive community-based deliberation and consensus-building process involving residents and families of West Moloka‘i; and

WHEREAS, the East End Policy Statement and West End Policy Statement represent Moloka‘i residents’ intimate knowledge of and self-determined visions for the future of their respective regions, describing the specific and unique resources, sites, challenges, threats, desired land uses, and priorities for planning and action in each region; and

WHEREAS, the Maui Planning Department had initial concerns regarding the inclusion of the full East End Policy Statement and full West End Policy Statement as formal Chapters of the Plan; and

WHEREAS, the Maui Planning Department has realized the importance of the detailed contextual information, knowledge, and mana‘o contained in the East End Policy Statement and West End Policy Statement, which reflect the specific will and intent of the East and West Moloka‘i communities, which are consistent with and complement the rest of the Plan, and which must be meaningfully taken into account in future county planning decisions and actions in order to best perpetuate the highly unique and special character, sites, lifestyles, and resources of East and West Moloka‘i; and

WHEREAS, Moloka‘i residents have also voiced a desire to recognize self-determined, community-based fisheries management as a conceptual framework for conserving and perpetuating their nearshore resources, to fulfill the subsistence needs of present and future generations; and

WHEREAS, while fisheries management does not fall within the jurisdiction of Maui County, recognizing the concept of community-based subsistence fishery management areas (CBSFAs) in the Moloka‘i Island Community Plan Update will ensure that this contextual vision and desire is documented and considered in relevant county actions and approvals; and

WHEREAS, the Maui Planning Department had concerns regarding references to the Mo‘omomi CBSFA in the Moloka‘i Island Community Plan Update, due to community disagreements; and

WHEREAS, specific references to the Mo‘omomi CBSFA have been removed from the Moloka‘i Island Community Plan Update, which continues to recognize CBSFA designation generally as a valuable management approach that reflects community members’ stand on protecting subsistence lifestyles through the specific use of generational knowledge and intimate daily familiarity with the resources of their respective places; and

WHEREAS, a Traditional Land Use Overlay designation has been developed and proposed for the Moloka‘i Island Community Plan Update, which utilizes GIS mapping, kūpuna knowledge, archaeological reports, and other information to identify important cultural and historic sites, site complexes, and landscapes throughout Moloka‘i for special consideration and protection in future land use planning and decision-making; and

WHEREAS, the Traditional Land Use Overlay designation and other land use designations developed specifically for the Moloka‘i Island Community Plan Update reflect the dedicated, hard work of Moloka‘i residents to ensure that future land use planning, permitting decisions, and other county actions are appropriate to their island and its resources, and as such these designations should not be considered as mere suggestions without the force and effect of law; and

WHEREAS, the Ho‘olehua Hawaiian Civic Club submitted this resolution to the Maui Council of the Association of Hawaiian Civic Clubs which gathered at its first Council Convention in Kahului, Maui in the malama of Hilinaehu on the rising of Kāloakūkahi on the 3rd day of September, 2018, and the council then submitted it as part of its package of adopted resolutions.

NOW, THEREFORE, BE IT RESOLVED, by the Association of Hawaiian Civic Clubs at its 59th Annual Convention in Kalapaki, Kauaʻi, in the malama of Welehu and the rising of ʻOlepau, this 17th day of November 2018, supports the adoption of the Moloka‘i Island Community Plan Update to include the full East End Policy Statement and West End Policy Statement as full chapters in the Plan, the recognition of community-based subsistence fisheries management as a desired conceptual framework for perpetuating the nearshore resources and subsistence traditions of Moloka‘i residents for present and future generations, and the adoption of land use designations that have the force and effect of law including the Traditional Land Use Overlay designation for cultural and historic sites, site complexes, and landscapes; and

BE IT FURTHER RESOLVED, that the Maui Mayor, the Maui County Council, and the Administration of the Office of Hawaiian Affairs are urged to facilitate the timely adoption of the Moloka‘i Island Community Plan Update to include the aforementioned critical components; and

BE IT FURTHER RESOLVED, that a certified copy of this resolution be transmitted to the Mayor of the County of Maui, the Chair of the Maui County Council, the Chair of the Planning Committee of the Maui County Council, the Maui County Councilmember representing the island of Moloka‘i, the Chair of the Moloka‘i Planning Commission, the Head of the Maui County Department of Planning, and the Chair of the Board of Trustees of the Office of Hawaiian Affairs, as well as to the Governor of the State of Hawai‘i, President of the State Senate, Speaker of the State House of Representatives, Chair of the State Senate Committee on Hawaiian Affairs, Chair of the State House Committee on Ocean, Marine Resources & Hawaiian Affairs, and all other County Mayors.

The undersigned hereby certifies that the foregoing Resolution was duly adopted in the malama of Welehu and the rising of ‘Olepau on the 17th day of November 2018, at the 59th Annual Convention of the Association of Hawaiian Civic Clubs in Kalapaki, Kaua‘i.
